Privacy Notice for Job Applicants

In this Privacy Notice, Ufenau Capital Partners AG (hereinafter "we" or "us") would like to provide you, as a job applicant (hereinafter "you" or "your"), with information about the processing of your personal data in connection with your job application. We are pleased that you are interested in working for us and have applied for a position in our company or one of the companies for which we are looking for suitable candidates on our career page (hereinafter referred to as a “Portfolio Company” or together the "Portfolio Companies").
If we or one of the Portfolio Companies conclude an employment contract with you, you will find the information on the associated data processing in a separate privacy notice for employees.

What data do we process? And for what purposes do we process your data?

We process your personal data that we have received in connection with your application only to the extent permitted by law. This includes, for example, curriculum vitae, details of certificates, diplomas, job references or confirmations, details of previous jobs and employers, referees and their contact details, information obtained from referees, details from interviews, assessments and aptitude tests, details about external mandates, functions and details from publicly accessible profiles in social media (insofar as these are intended for business or professional use) and further details from the application and from the internet and other public sources.
In particular, we process your data for the following purposes:
  • to the extent necessary, to assess whether you are a suitable candidate for the position you have applied for (or any other open positions in our company or Portfolio Companies);
  • to carry out the application process (e.g. planning and conducting interviews, internal evaluation process);
  • to initiate any subsequent implementation of the employment contract (e.g. issuing an offer to conclude the contract, necessary steps in the onboarding process).

We also process your personal data by forwarding your application for a position at a Portfolio Company to the Portfolio Company concerned for further processing of your application.If you have given your consent, we will process your personal data for the purposes of our applicant pool, which means that your personal data will be collected for other possible jobs or positions in our company or a Portfolio Company and retained for a certain period of time (see below).

On what legal basis do we process your data?

We process your personal data on the basis of the Swiss Data Protection Act (DPA) and - if and insofar as the European Regulation (EU) 2016/679 of 27 April 2016 (GDPR) should be applicable - data processing may take place on the basis of the requirements of art. 6 GDPR.

How long do we process your data?

In the event that your application is rejected, your personal data will be deleted six months after the application process has been completed, i.e. after you or we have rejected your application.

If an employment contract is concluded between you and us following the application process, your data will be transferred from the applicant data system to our human resources information system or that of a Portfolio Company and kept there at least for the duration of your employment.

In the event that you have agreed that your personal data provided with your application may continue to be stored, we will transfer your personal data to our talent pool. Your personal data will be deleted from the talent pool after two years.

Whit whom do we share your personal data?

We may disclose personal data to third parties if this is necessary for the purposes of data processing mentioned above.For the application process, we work together with the specialised software provider "Personio GmbH" based in Munich, Germany (further details and contact information can be found at: https://www.personio.de/impressum/). Personio GmbH acts as a service provider and order processor for us and may, for example, also gain knowledge of your personal data in connection with maintenance work and the maintenance of the systems. We have concluded a so-called data processing agreement with Personio GmbH, which ensures that the data processing is carried out in compliance with the applicable legal provisions.

Your personal data is stored and, if necessary, processed in data centers of Amazon Web Services in Frankfurt am Main, Germany, but your personal data is not stored or processed outside of the EU.

After receiving your application, your personal data will be reviewed by our human resources department. Suitable applications are then forwarded internally to the person responsible for the respective open position. In our company, only those persons have access to your data who need access for the above-mentioned processing purposes.

If you have applied for a position at a Portfolio Company, we will pass on your personal data to the respective Portfolio Company for further processing of your application.

What are your rights?

To help you control the processing of your personal data, you have the following rights in relation with our data processing, depending on the applicable data protection law:You have the right to request information from us as to whether and what data we process from you. If your wish to exercise the above-mentioned right, you can contact us at any time, preferably in writing and free of charge. Please note that we will then ask you to provide proof of your identity.

You have a right to request correction of your personal dataif you are entitled to this right by law. You can therefore ask us to correct, complete or delete your personal data at any time and free of charge if it is incorrect.

Furthermore, you have the right to object to processing of your personal data and the right to request erasure of data ifwe are not obliged to continue processing or storing this data and if this personal data is also not necessary for the implementation of a possible subsequent employment relationship.Finally, to the extent provided by law, you have a right to request the transfer of personal data.

Where our processing is based on your consent, you have the right to withdraw consent at any time.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. Rights of data subjects

If Personio SE & Co. KG as the controller processes personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced.
